We are looking forward to welcoming you to one of our Overland journeys. However, we would like you to carefully read our booking conditions first:
LOA LUPITA OVERLAND ADVENTURES SRL DE CV, valid from 1st January 2022
If you book a Lupita Trip, you must agree that Mexican Law (and no other) will apply to your contract and any dispute which arises between yourself and LOA LUPITA OVERLAND ADVENTURES SRL DE CV.
a. If you wish to cancel your tour, the lead name must inform us in writing an e-mail to [email protected]. Cancellation charges are calculated on the day written notification is received by us. The table below shows the number of days before the tour departure that we received written notification and the percentage of the tour cost:

b. Please note the cancellation charges mentioned above do not cover extra hotel accommodation. Extra hotel accommodation may incur 100% cancellation charges after booking.
c. Please note we do not refund any flights or transportation to/from the beginning/endpoint of your tour.
d. Once the tour has started, no refunds will be made under any circumstances for any unused section(s).
e. We reserve the right to cancel your tour for any reason outside our control. In the event of a cancellation, we will tell you as soon as possible. Our tours require a minimum number of 5 participants to enable us to operate them. If the minimum number has not been received, we are entitled to cancel it. We will notify you of cancellation for this reason no later than 60 days prior to departure.

No compensation will be payable if we cancel due to your failure to comply with any requirement of these booking conditions.
a. Once you have booked, we will do our best not to alter any of the ingredients of your tour. However, because of the unpredictability of travel, sometimes we may need to do changes. Where tours have a significant change (see 8.c.), we will notify you as soon as possible. If there is time before departure, you may then:
b. If we have to make a significant change, we will pay you the compensation in the table below depending on the following exceptions. We do not have liability beyond offering the choices above where we need to make a change due to circumstances beyond our control. The table below shows the number of days we notify you before the tour departure date and the compensation payable:

c. A significant change is one affecting at least one day in five of the itinerary.
d. We reserve the right to use alternative transport or vary the itinerary if force majeure, breakdown, accident, sickness, etc.
e. Because of the nature of the areas we travel through, significant changes can occur after departure. On rare occasions, force majeure may require us to curtail a tour before its end. We will organize contingency itineraries but have no responsibility for compensation, additional expenses or refunds (unless we obtain any refunds from our suppliers) in respect of any services you don’t use.
f. All changes which are not significant are minor changes. Minor changes may occur at any time before or after the tour departure. While we will make reasonable efforts to inform you of minor changes, we are under no obligation to do so. We do not need to pay any compensation and the options in clause 8a. will not be available in respect of a minor change.
a. We have compiled all information on our website with reasonable care and is published in good faith.
b. We promise to provide all tour arrangements with reasonable skill and care. Subject to these booking conditions, we will accept responsibility if, for example, your tour arrangements prove deficient as a result of the failure of our employees or suppliers.
c. It is your responsibility to show that we haven’t used reasonable care if you make a claim against us. In addition, we will only have responsibility for what our employees and suppliers do or do not do within the course of their employment. Regardless of any wording used by us in our website or elsewhere, we only promise to use reasonable skill and care as set out above.
d. We have no responsibility for any injury, illness, death, loss, damage, cost or other sums which results from any of the following:

Where you base any claim (including death or personal injury) on any travel arrangements (including the process of getting on and off the transport) from any air, sea or rail carrier to which any international convention or Mexican regulation applies, the maximum amount of compensation we will have to pay has a limit.
f. The most we will have to pay you if we are liable is the most the carrier would have to pay under the regulation which applies. Where a carrier would not need to make any payment to you under the applicable regulation, we similarly don’t need to make any payment. When making any payment, we may deduct any money which you have received or receive it from the carrier.
g. Where we are liable for loss and/or damage to any personal possessions, the maximum amount we will pay you is 1,000 USD per person unless a lower limitation applies to your claim under clause 10d. You must ensure you have appropriate travel insurance to protect your belongings. For all other claims which do not involve death or personal injury, if we are liable to you, the maximum amount we will have to pay is twice the price unless a lower limitation applies under any other clause of these booking conditions. This maximum will only be payable where everything has gone wrong and you have not received any benefit at all.
h. The acceptance of liability in clause 10.b. does not apply to arrangements which do not form part of the tour. We book such arrangements as agent only on the express condition that we and our crew members will not liable for any expenses, loss, damage, injury or negligence arising from the actions or omissions of the supplier.
i. We cannot accept any liability for any delay or cancellation in your flights, whether it is due to adverse weather conditions, rescheduling by an airline, airport authority and/ or action by air traffic controllers or mechanical breakdown.
j. We accept no responsibility for expenses, inconvenience, loss of enjoyment or anything else caused by noncompliance with any of your responsibilities listed below.
a. By nature, our tours may involve personal risks that are not normally associated with holiday tours. The safety standards of suppliers of accommodation, transport and other operators in the countries you visit will not be of the same standard as in your home country.
b. In booking from our website, you acknowledge that you are responsible for checking your Government’s Foreign Office warnings concerning the safety of countries you will be travelling through.
c. We encourage all travellers to have adventure travel insurance with cover for personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of GBP 5,000,000 / USD 6,000,000. We recommend that the policy covers trip and flight cancellation, curtailment, personal liability, loss of luggage and personal effects. Additionally, we recommend that you take out your insurance policy as soon as our tour booking is confirmed. Please provide your insurance policy number and the emergency contact number before your trip. If you have insurance connected to your bank account please ensure you have details of the participating insurer, the policy number and emergency contact number with you.
d. It is your responsibility to ensure that your insurance is adequate for your particular needs and for the tour you are undertaking.
e. It is your responsibility to ensure you seek professional medical advice before travelling and to take all necessary health precautions and preventive measures. Health requirements and recommendations may change and you must check the up-to-date position in good time before departure.
f. You are responsible for informing us in writing at the time of booking of any illnesses, disabilities or medical conditions, or, if not known at the time of booking, at the earliest opportunity. If you are found to have an undeclared medical condition you may be ordered to leave the tour with no refund.
g. It is your responsibility to comply with all current passport, visa and health requirements. Requirements may change and you must check the up-to-date position in good time before departure. You must check the visa requirements with the embassy of the countries you are travelling. Passports must have a minimum of six months’ validity from the date you return home.
h. We cannot accept liability if you are refused entry into any transport or country due to failure on your part to carry all required documentation. If failure to have any necessary documentation results in any financial penalty being imposed on us, you will be responsible for reimbursing us.
i. You must comply with the laws and drug regulations of all countries visited and travel following our responsible travel policy. Our crew may direct you to leave the trip if you fail to do so with no liability on our part and no right to refund.
j. The decision of our crew is final on all matters likely to affect the safety or well-being of any traveller or staff. If you fail to comply with a decision made by our crew or interfere with the well-being or mobility of the group, our crew may direct you to leave the trip, with no liability on our part and no right of refund. Should you present a medical condition, our tour leader reserves the right to insist that person seek medical advice. If you decline to act upon this advice, you may be asked to leave the tour. This extends to physical, mental and behavioural conditions.
k. Clients must follow the tour joining instructions issued to them.
l. You must be aware that our crew and passengers may take photographs and film footage of our clients while on tour. We reserve the right to use such material for advertising without obtaining further consent. We also reserve the right to use any comments clients make regarding our tours on any questionnaires.
