1. The Contract & Payments
  • Jurisdiction: Your contract and any disputes are governed exclusively by Mexican Law.

  • Confirmation: A contract is in effect once we receive your deposit and issue a confirmation invoice.

  • Late Payments: If the balance is not paid by the due date, we will send a reminder. If payment is not received within 7 days of that reminder, your booking will be considered cancelled by you, and standard cancellation charges will apply.

  • Pricing & Errors: We reserve the right to correct obvious errors in pricing (e.g., technical glitches or “typos”). If an obvious error occurs, we may cancel your booking and provide a full refund.

  • Price Surcharges: We won’t change your price within 90 days of departure. For earlier changes (due to major exchange rate shifts), if the increase exceeds 10%, you may cancel for a full refund.

  • Private Tours & Transportation Services: 50% non-refundable deposit required to guarantee departure. Balance due 30 days before the start date.

  • Group Tours:

    • > 90 days before departure: 20% non-refundable deposit required. Balance due 60 days before start.
    • < 90 days before departure: Full payment required at booking.

  • Mandatory Local Operational & Community Fund (If applicable): For expeditions where a Local Fund is required (as indicated in your booking details or itinerary), this mandatory cash portion must be paid directly to the Expedition Leader on Day 1 of the trip in clean, undamaged United States Dollars (USD) cash.

  • Cancellations by us:

    • Low Participation: If we cancel the tour because the minimum group size (6 people) is not met, you will receive a 100% refund.
    • Force Majeure: If a cancellation is necessary due to circumstances beyond our control (safety, extreme weather, political instability, etc.), we will refund your payment minus any non-recoverable costs already incurred (e.g., taxes, non-refundable bookings, and administrative fees).

2. Cancellations & Transfers
  • Cancellations by You: Notification must be sent in writing via email to [email protected].

    • More than 90 days: Deposit retained as credit for 1 year toward a future trip operated by Lupita Overland – valid for 1 year from the date of cancellation.

    • 89 to 61 days: 50% of the total tour cost is forfeited.

    • 60 days or less: 100% of the total tour cost is forfeited.

  • Transfers: Transfers to another tour requested 60+ days before departure incur a $50 USD fee plus non-recoverable costs. Within 90 days, cancellation fees apply. Transfers are only permitted between tours operated by Lupita Overland.

  • Note: Extra services (pre/post-hotels, single accommodation, trip extensions) and flights are non-refundable. No refunds are given for unused sections once the tour has started.

3. Itineraries & Deviations
  • Itineraries: These are “statements of intention.” We reserve the right to modify routes due to weather, road conditions, or safety (Force Majeure).

  • Emergency Costs: If a route must be changed (e.g., border closures or safety risks), any additional costs for emergency transport, such as flights to bypass an area, will be the responsibility of the traveller.

4. Your Responsibility
  • Travel Insurance: Mandatory. Your policy must explicitly cover personal injury, medical expenses, and emergency repatriation. You must provide your policy number and 24-hour emergency contact details before Day 1. Without these, you will not be permitted to join the trip, and no refund will be provided.

  • Health & Fitness: You must declare medical conditions at booking. We may request a doctor’s assessment if we believe a condition may affect your safety. Failure to provide this may result in cancellation without a refund.

  • Code of Conduct: We travel as a community. Respecting local laws, crew instructions, and fellow travellers is a condition of booking. We maintain a zero-tolerance policy for illegal drugs, sexual harassment, or behaviour that jeopardises group safety or harmony. Our crew reserves the right to remove any traveller who violates these standards; in such cases, no refund is issued, and all return travel costs are the traveller’s responsibility.

  • Assumption of Risk & Liability Release: By booking with us, you voluntarily assume all inherent risks associated with overland travel and adventure activities in remote environments—including camping, outdoor cooking, trekking, water activities, and road transport—where medical facilities may be limited. You hereby release LOA LUPITA OVERLAND ADVENTURES S DE RL DE CV and its crew from any claims or liabilities for personal injury, illness, or property damage, except in cases of proven gross negligence.

  • Safety Waivers: Certain activities en route may also be provided by third-party local partners. You may be required to sign an additional safety waiver provided by local operators or by our crew before participating in specific activities. If you choose not to sign, participation in that activity may be denied without a refund.

  • Documents: You are responsible for valid passports (6 months+ validity), visas, and health requirements.

5. Our Responsibility
  • Standard of Care: We promise to provide tour arrangements with reasonable skill and care.

  • Personal Possessions: We accept no liability for loss or damage to personal belongings (electronics, jewellery, cash) left in our vehicles or at accommodations. These are carried at your own risk.

  • Liability Cap: For non-injury claims, our liability is limited to a maximum of the price of the tour.

6. Media & Marketing
  • Marketing Consent: By joining the tour, you consent to our crew taking photographs or video footage of you for use in our publicity, social media, and marketing materials.

  • If you prefer not to appear in our media, please inform us when filling out your pre-departure form. While we will do our best to respect your request in individual shots, please understand that appearing in group photos and background footage is often inevitable due to the nature of group travel.
7. Complaints
  • If you have an issue, inform your Tour Leader immediately so we can attempt to resolve it. If unresolved, email [email protected] within 30 days of the trip ending.
